Video: This footage used by Garda to catch and punish close-pass driver

The driver in this car was fined and sanctioned with penalty points based on the video footage below

A cyclist who secured one of the first successful outcomes against a driver by using self-recorded footage has done it again.

The rider - who goes under the @righttobikeit Twitter handle - has shared the clip below saying the driver had been penalised under the fixed charge notice, or penalty points, system.

He said he has just been contacted by the Garda, to whom he passed on the video, and was told the driver got an €80 fine and two penalty points.

It is important to note that the registered owner of this car was not the person driving at the time of this incident.

Another person was driving the vehicle at the time and they were sanctioned for the manner of their driving captured in the video below.

This incident occurred back in mid October, meaning the outcome of it has been reached very quickly.

It was first reported through the Trafficwatch facility and the driver was sanctioned for driving without due consideration.

This particular case pre-dates a change in the law introduced last November which created a specific offence of dangerously overtaking a cyclist.

That can be used any time cyclists believe a driver has overtaken them in a dangerous manner, which the sanction for that being three penalty points and a €120 fine.
