Irish cyclist who was “no Sean Kelly” awarded €13,400 for sun lounger fall

He had bought the sun lounger but it collapsed under him and now the case has gone to court.

 

A pensioner and former avid cyclist forced to give up the bike after failing off a sun lounger has been awarded €13,400 in compensation.

Frank O’Reilly (67), Clonmel, Tipperary, injured his knee and back when the sun lounger he had bought from Argos collapsed. He was laying on it at home at the time.

The Dublin Circuit Court was told while his back healed quickly his knee proved a bigger problem. And he was never able to return to cycling.

He was a sportive rider and said while he was not a talented cyclist had had enjoyed it.

“I was no Sean Kelly, but I enjoyed it,” he told Mr Justice Raymond Groarke.

“And having to give up cycling had the biggest impact on my life as a result of the accident.”

Argos had conceded liability for the incident in June, 2012, and the court hearing was only to determine the compensation sum.

He said he had not gone to his doctor about the injuries at the time and that his trips there related to other health matters.

However, while he also did not take pain medication he said that did not mean his injury was minor or discomfort.

Mr Justice Groarke noted Mr O’Reilly’s contention that his knee injury resulted in its totality from the sun lounger collapsing under him.

However, he said the former cyclist had not furnished medical evidence to support that argument and also had a pre-existing wear and tear to his knee.
