Cyclist held 80% liable for Dublin crash settles case for €190,000

A cyclist who suffered devastating head injuries after a crash with a taxi driver in Dublin has settled his High Court case for €190,000

A cyclist who was found 80 per cent responsible for a crash with a taxi driver, after he broke a red light at a junction in Dublin, has settled his case for €190,000. The cyclist was thrown in the air on impact and banged his head, suffering very serious head injuries.

The cyclist had claimed there was a failure on the part of the driver to keep a proper look out while he was behind the wheel. However, the driver contested the claims.

The taxi man said the cyclist had ridden through a red light at the junction in Dublin's north inner city. He told the court when the light turned green for him, he advanced forward in his taxi and hit the cyclist on the junction.

The case was settled at the High Court, with a sum of €190,000 payable to the cyclist. Ms Justice Leonie Reynolds told the court the settlement reached between the two sides was based on the cyclist carrying 80 per cent liability and the the taxi driver 20 per cent.

The judge congratulated both sides on the settlement, adding she had no hesitation approving the sum and the terms of the agreement between both sides.

The cyclist - Anton Mazilu, Comuna Halaucesti, Romania, had sued taxi driver Derek Kiernan, Westbrook Drive, Balbriggan, Co Dublin, over the crash at 6.20am near North Strand Road in Dublin's north inner city on July 27th, 2020.

The court was told that Mr Mazilu had landed on his head and suffered very serious head injuries. However, while Mr Mazilu claimed Mr Kiernan had failed in his duty to see another road user, in what were wet conditions, Mr Kiernan rejected this.

He said Mr Mazilu had ridden through a red light and across the junction, which was unsafe and created a situation which was completely unexpected. This, he said, resulted in Mr Mazilu cycling across his path as he pulled away from the lights once the light turned green in his - Mr Kiernan's - favour.

The court was also told Mr Mazilu's cycling through the red light gave Mr Kiernan no chance to see him and that dashcam footage of the incident was also available.

Mr Mazilu was a self-employed welder working in Dublin at the time of the crash. He went to live with his daughters in Italy during his recovery and had since returned to his native Romania, the court was told.
