Cyclist and well known solicitor awarded €120,000 after knocked from bike by car

The High Court has made an award of €120,000 after a motorist was sued by a cyclist for broken ribs and other injuries sustained when he was knocked from his bike during a case of dangerous driving. The injured party is Julian Yarr (above) who is a managing partner in A&L Goodbody.

 

 

A well known figure in the legal field in the Republic has been awarded €120,000 in damages for injuries he sustained when he was knocked from his bike by a car as he cycled to work.

Julian Yarr, a managing partner of A&L Goodbody, sustained serious injuries when he was struck by the vehicle on the Rock Road, Blackrock, south Dublin, three years ago.

The High Court was told that Mr Yarr was the victim in a "frightening" accident caused by motorist Brian Biggins of Culleen, Headford, Co Galway on July 26th, 2011.

He suffered broken ribs and injuries to his neck, shoulders and hands when knocked to the ground near the entrance of Blackrock Clinic.

Mr Justice Michael Hanna was told that as Mr Yarr was riding towards work near the clinic entrance, Mr Biggins’ car turned from the opposite side of the road and hit him.

Mr Yarr was thrown from his bike and over the bonnet of Mr Biggins’ car and into the path of oncoming traffic.

The injured man was not in a position for a period to return to his job, which is with one of the biggest law firms in the country. Instead, he spent eight days in St Vincent’s Hospital where he was taken to from the scene of the accident.

Mr Yarr, Marlborough Road, Glenageary, Co Dublin, sued Mr Biggins’, claiming he had driven in a negligent manner and that he had caused the injuries as a result.

Liability in the case was admitted and the court was asked only to decide on the extent of the damages the injured party was entitled to.

Mr Justice Hanna said had Mr Yarr not been wearing a helmet at the time his injuries may have been a lot worse.

However, given the serious of the collision and of the injuries that were sustained, an award of €120,000 was made.
