
A cyclist in Munster has been given a scare by an overtaking move involving a Bus Éireann driver in a coach. The cyclist - who goes under the @righttobikeit handle on Twitter - shared a clip of the incident on Twitter today.
It shows him riding along a narrow road when the bus driver passes him. The cyclist has decided to report it to see what the Garda thinks of this move.
Since November 2019 it has been a specific road traffic offence to dangerously overtake a cyclist. While dangerous overtaking was always an offence, the 2019 change in legislation introduced a specific offence relating to drivers overtaking cyclists.
That new offence was created as a compromise when the Government decided it would be too difficult to introduce a specific offence of overtaking a cyclist without leaving a gap of at least 1m or 1.5m.
Some of the complaints taken to gardai since then, supported by video evidence, have been rejected as the overtaking was not deemed in breach of the law. Other incidents have resulted in fines and penalty points for drivers. In a very small number of cases cyclists have been warned about their conduct on the roads.
