
A 16-year-old who crashed off his bike aged 8 years old and cut his lip has been awarded €65,000 by the High Court.
The court was told the boy was cycling in a west Dublin
housing estate when his front wheel hit a pothole.
He crashed to the ground as a result and suffered a deep
laceration in his lip. The injury required medical treatment, including
stitches.
Malcolm Akpaka was cycling in Cruise Park Close,
Tyrrelstown, west Dublin, when he crashed in July, 2011.
Mr Justice Garret Simons was told while he was treated at
the time; Malcolm Akpaka has been left with scarring due to the injury.
He was suing Fisher Property Management Ltd, Main Street,
Ongar, Dublin and Tyrrelstown No 8 Management Company Ltd care of Fisher
Property Management.
The latter body was responsible for the maintenance of
the area where the crash occurred and where Malcolm Akpaka currently lives.
Earthwood Ltd, The Plaza, Tyrrelstown, was also part of
the action as it had built the road where the crash occurred.
The court was told the pothole the boy hit was between a
footpath and the tarmac road. Liability was denied by the three parties who
were defendants in the action.
The court made an order ruling the settlement, though it
was done without any admission of liability.
