Boy (15) who cycled into car on roundabout sued driver for €60,000
The boy was cycling the wrong way around the roundabout when he hit the car and took his case to the courts.
A 15-year-old boy who was injured in collission with a car when cycling the wrong way around a roundabout sued the driver for €60,000.
However, now aged 18-years he has lost his case before the Circuit Civil Court.
Glenn McCarthy Newcastle Woods Crescent, Enfield, Co Meath, rode into the side of the 4X4 vehicle while it was stationery on the entrance to the roundabout.
The vehicle was being driven by Sean Mooney of Slanduff View, Kentstown, Navan.
The collission occurred on June 27th, 2014, at the junction of Coldcut Road and Fonthill Road in Clondalkin, west Dublin.
Mr McCarthy told the court he was cycling with a friend on the day, was not wearing a helmet and was not an experienced cyclist.
The court was told he was on a bike path that was used in both directions on the round-about.
Mr Field said when he was stopped at the roundabout with his handbrake on he saw a flash to the side of his car. He then saw a boy get up off the ground and walk away to the other side of the road.
Mr McCarthy said he had suffered a number of injuries including his head, knee and right elbow. He told the court he was on crutches for about eight weeks but had no problems after that period.
The court heard there was some damage to the vehicle’s wing mirror from the impact of the boy riding into it.
Judge Linnane said no liability had been established against Mr Field.
“The damage to Mr Mooney’s vehicle was consistent with Mr McCarthy going into the side of the jeep," Judge Linnane said.
"And I am satisfied Mr Mooney was taking all due care and no liability has been established against him."
No order has been made in relation to costs pending an appeal.
